1. Agreement to Terms

By accessing or using the Aklar Security website at aklarsecurity.ca, or by engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. These terms apply to all visitors, clients, and anyone who accesses or uses our website or services.

2. About Aklar Security

Aklar Security is a Canadian security surveillance company headquartered in Edmonton, Alberta. We provide mobile and permanent security camera systems, remote monitoring services, and integrated security solutions to clients across Canada.

3. Services

Aklar Security offers the following services:

• Supply and installation of mobile surveillance units including Pole Units, Tower Units, and Solar+ Generator Trailers

• Permanent integrated security camera and access control systems

• Remote monitoring through a UL listed monitoring station

• On-site deterrence including siren activation and audio talk-down

• Guard and police dispatch coordination

Service details, scope, pricing, and duration are defined in individual service agreements entered into between Aklar Security and the client. In the event of any conflict between these Terms and Conditions and a signed service agreement, the service agreement will prevail.

4. Pricing and Payment

Activation fees are one-time charges payable upon commencement of service. Monthly subscription fees are billed in advance for each billing period. Additional alarm events beyond the 20 included per month are billed at $15 per event.

All prices are in Canadian dollars and are subject to applicable taxes. Aklar Security reserves the right to update pricing at any time, with notice provided to existing clients prior to any changes taking effect.

Payment is due within the timeframe specified in your invoice. Late payments may result in suspension of monitoring services. Aklar Security is not liable for any losses arising from service suspension due to non-payment.

5. Minimum Term and Cancellation

Standard service agreements require a minimum commitment of 4 months. After the minimum term, service continues on a month-to-month basis unless cancelled with written notice as specified in your service agreement.

Short-term deployments of less than 4 months are available on a case-by-case basis and are subject to separate short-term pricing. Contact us for details.

Early termination prior to the end of the minimum term may result in an early termination fee as specified in your service agreement.

6. Equipment

All equipment supplied by Aklar Security remains the property of Aklar Security at all times unless explicitly stated otherwise in a written agreement. The client is responsible for:

• Ensuring safe and reasonable access to the equipment at all times

• Not tampering with, modifying, or relocating equipment without prior written consent from Aklar Security

• Reporting any damage, theft, or malfunction to Aklar Security promptly

• Keeping the area around installed equipment clear and accessible

The client assumes liability for any damage to Aklar Security equipment caused by negligence, misuse, or failure to provide a safe operating environment. The cost of repair or replacement of damaged equipment will be the responsibility of the client where damage results from client negligence.

7. Monitoring and Response

Aklar Security's monitoring station operates 24 hours a day, 7 days a week, 365 days a year. Each subscription includes 20 alarm events per month. Additional events are billed at $15 per event.

Aklar Security will make reasonable efforts to respond to confirmed alarm events promptly. However, Aklar Security does not guarantee specific response times and is not liable for any losses, damages, or incidents that occur despite monitoring being active. Response actions including siren activation, audio talk-down, guard dispatch, and police notification are carried out at the reasonable discretion of the monitoring operator.

Aklar Security does not guarantee the prevention of theft, vandalism, trespassing, or any other incident. Our services are designed to detect, deter, and respond to security events, but we cannot guarantee outcomes.

8. Client Responsibilities

The client agrees to:

• Provide accurate information about the site and security requirements

• Ensure Aklar Security personnel have safe and unobstructed access to the site for installation, maintenance, and retrieval of equipment

• Comply with all applicable laws regarding the use of surveillance systems on their property, including notifying individuals of the presence of cameras where required by law

• Not use Aklar Security equipment or services for any unlawful purpose

• Inform Aklar Security of any changes to site conditions that may affect equipment performance or safety

9. Privacy and Surveillance Compliance

The client is solely responsible for ensuring that their deployment of surveillance cameras complies with all applicable federal and provincial privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial legislation. This includes but is not limited to the placement of appropriate signage notifying individuals of camera surveillance where required by law.

Aklar Security will handle footage and personal data in accordance with our Privacy Policy, available at aklarsecurity.ca/privacy-policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Aklar Security shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages

• Loss of profit, revenue, data, or business opportunity

• Any theft, vandalism, damage, injury, or loss that occurs on a client's site despite monitoring services being active

• Any failure or interruption of service caused by circumstances beyond our reasonable control, including but not limited to power outages, network failures, extreme weather, or force majeure events

Aklar Security's total liability to any client for any claim arising out of or related to our services shall not exceed the total amount paid by that client in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Aklar Security, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in connection with your use of our services, your breach of these Terms, or your violation of any applicable law or third-party rights.

12. Intellectual Property

All content on the Aklar Security website, including text, images, logos, graphics, and code, is the property of Aklar Security and is protected by applicable Canadian intellectual property laws. You may not reproduce, distribute, or use any content from this website without our prior written consent.

13. Website Use

You agree to use the Aklar Security website for lawful purposes only. You must not use the site in any way that could damage, disable, or impair the site or interfere with any other user's access. Automated scraping, data harvesting, or any form of unsolicited communication directed at Aklar Security through the website is prohibited.

14. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. Aklar Security has no control over and accepts no responsibility for the content, privacy practices, or terms of any third-party sites.

15. Changes to Services and Terms

Aklar Security reserves the right to modify, suspend, or discontinue any aspect of its services at any time, with reasonable notice to affected clients. We also reserve the right to update these Terms and Conditions at any time. The updated version will be posted on our website with a revised date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.

16. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Alberta.

17. Entire Agreement

These Terms and Conditions, together with any signed service agreement and our Privacy Policy, constitute the entire agreement between you and Aklar Security with respect to your use of our website and services, and supersede all prior understandings or agreements.
